The agreement that governs your use of Colonial Landscaping & Snow Removal’s website, services, and communications (including SMS).

Effective Date: December 10, 2025


1) Acceptance of These Terms

Welcome to Colonial Landscaping & Snow Removal (“Colonial,” “we,” “us,” or “our”). By using our website, requesting a quote, booking a service, or interacting with our communications (including SMS), you agree to these Terms of Service (“Terms”). If you do not agree, please discontinue use of our services.


2) Services & Scope of Work

Colonial provides residential and commercial landscaping, hardscaping, lawn maintenance, property care, and snow/ice management services.

Scope & Estimates

All services, materials, and project details are defined in your estimate, proposal, or signed work order.

Landscaping and construction project pricing may vary based on site conditions, access, materials, and weather.

Seasonal services (e.g., mowing, cleanup, snow removal) may follow recurring schedules and may be subject to weather conditions.

Any additional work requested outside the original scope may require a revised estimate and added fees.


3) Scheduling, Access & Safety

Property Access

You agree to provide safe, timely access to the property, including gates, driveways, parking areas, and service zones. If access is blocked, delayed, or unsafe, we may reschedule or charge a service fee.

Safety Limits

For safety and compliance, Colonial does not perform:

Hazardous or unsafe work

Work requiring unpermitted structural modifications

Handling of biohazards, pest infestations, or chemical cleanups

Work involving unstable surfaces or dangerous site conditions
You agree to disclose any known hazards at or near the work site.

Pets & Outdoor Areas

Please ensure pets are secured. We are not responsible for pet escape, outdoor damage caused by pets, or pet-related hazards (waste, digging, fencing issues).


4) Pricing, Payment & Taxes

Estimates & Revisions

Estimates are based on information provided and job-site conditions at the time of quoting. Pricing may be adjusted if:

Conditions differ materially (overgrowth, debris, grading issues, snow depth, vehicle blockages)

Additional work or materials are needed

Weather delays require rescheduling or additional labor

Payments

A valid payment method, deposit, or contract signature may be required to begin work.

You authorize Colonial to charge for services, materials, add-ons, change orders, taxes, or final balances according to your agreement.

Late or failed payments may incur reasonable fees, interest, or suspension of further services.


5) Cancellations, Rescheduling & No-Show Policies

Non-Seasonal Services

For landscaping visits, cleanups, or one-time services:

Please reschedule as early as possible.

Changes within 24 hours of the appointment may result in a fee to cover crew scheduling costs.

Snow & Ice Management

Due to the unpredictable nature of weather events:

Snow removal schedules are based on storm timing, severity, and route prioritization.

Cancellations for seasonal contracts are subject to contract terms and may not be refundable once the season begins.

Lock-Out / No Access Fees

If crews arrive and cannot begin work due to locked gates, blocked driveways, unsafe conditions, or vehicles obstructing access, a lock-out fee may apply.


6) Satisfaction Guarantee

If you believe part of the service was missed or completed incorrectly, notify us within 24 hours with photos or details. We will assess and, if appropriate, return to address the concern.
Re-services do not cover weather changes, natural regrowth, new debris, or items outside the original scope.


7) Condition Limits & Exclusions

Colonial does not guarantee:

Removal of permanent stains, deep-rooted weeds, fungus, moss, or long-term soil issues

Correction of drainage problems without a signed drainage/grade improvement contract

Damage caused by pre-existing conditions, poor soil quality, pests, rot, or improper prior installation

That lawns, plants, or landscaping materials will thrive if weather, irrigation, or care conditions are not maintained by the client

We do not move heavy equipment, vehicles, or structures without proper arrangements.


8) Damages & Claims

Please report any alleged damage within 24 hours of service. Provide photos and a written description so we may investigate.

Our liability is limited to:

The amount paid for the service that caused the claim or

The reasonable cost of repair/replacement
Whichever is lower, subject to applicable law.

We are not responsible for damage to underground utilities, irrigation lines, wiring, invisible fences, or unmarked property infrastructure.


10) Photos, Reviews & Testimonials

With your permission, crews may take before/after photos of work performed for quality control or marketing.
If you submit a review or testimonial, you grant Colonial a non-exclusive license to use it for promotional purposes.


11) SMS Program Terms (“Colonial Landscaping SMS Alerts”)

Program Description: After you opt in, you may receive messages related to your account and services, including quotes, booking confirmations, schedule updates, reminders, service follow-ups, review requests, and occasional promotions.

Cancel (Opt-Out): You can cancel the SMS service at any time by texting STOP to our number. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. After this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially and we will resume sending SMS messages to you.

Help: If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or contact us at [email protected].

Carrier Liability: Carriers are not liable for delayed or undelivered messages.

Message & Data Rates: Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text or data plan, contact your wireless provider.
